TERMS OF SERVICE – SEND A LEAD

These Terms of Service (“Terms”) govern access to and use of the SEND A LEAD websites, applications, dashboards, APIs, and related services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms.
If you use the Services on behalf of a company or organization, you represent and warrant that you have the authority to bind that entity (“Customer”).
1. Description of Services
Send A Lead provides AI-enabled business automation and communication tools, which may include:
- SMS and voice messaging workflows
- Email communications
- AI agents and conversational automation
- Lead qualification and appointment scheduling
- Analytics, dashboards, and third-party integrations
Features and availability vary by plan, configuration, carrier policies, and applicable law.
2. Eligibility (18+)
The Services are intended only for individuals who are at least eighteen (18) years of age. By using the Services, you represent and warrant that you meet this requirement.
3. Accounts and Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity conducted under your account. You must notify us immediately of any unauthorized access or security incident.
4. Fees and Billing
All fees (including subscription, setup, and usage-based charges) are disclosed at checkout, in an invoice, order form, or written agreement. Fees are non-refundable unless required by law. Failure to pay may result in suspension or termination of Services.
5. Customer Responsibilities & Legal Compliance
You are solely responsible for how you use the Services and for compliance with all applicable laws, regulations, and carrier rules, including but not limited to:
- TCPA, CAN-SPAM, GDPR, India DPDP Act
- A2P messaging and carrier policies
- Consent and opt-in requirements
- Do-Not-Call (DNC) restrictions
- STOP / HELP opt-out handling
- Call recording and monitoring disclosures
You represent and warrant that you have obtained valid, express consent from all recipients before sending communications.
6. SMS Messaging Terms (A2P REQUIRED)
Send A Lead enables SMS messaging as part of its Services. Messages sent through the platform may include:
- Account notifications
- Customer support messages
- Appointment reminders
- Transactional updates
- Conversational or AI-assisted responses
Message frequency varies. Message and data rates may apply.
Recipients may opt out at any time by replying STOP to any message. For assistance, reply HELP or contact [email protected].
Wireless carriers are not liable for delayed or undelivered messages.
7. Acceptable Use
You may not use the Services to:
- Send spam, scams, misleading, or unlawful communications
- Violate laws or third-party rights
- Transmit malware or harmful code
- Interfere with system security
- Reverse engineer or copy the Services
- Build or support a competing product
Violations may result in immediate suspension or termination.
8. AI Outputs
AI-generated content may be inaccurate or incomplete. You are responsible for reviewing and approving all outputs before use. Send A Lead does not provide legal, financial, or professional advice.
9. Third-Party Services
The Services may integrate with third-party providers (e.g., carriers, CRMs, email providers). We are not responsible for third-party outages, filtering, pricing changes, or policy enforcement.
10. Termination
We may suspend or terminate access if you violate these Terms, fail to pay fees, or if required by law or carriers. Upon termination, your right to use the Services ends.
11. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES TO THE MAXIMUM EXTENT PERMITTED BY LAW.
12. Limitation of Liability
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE THREE (3) MONTHS PRECEDING THE CLAIM.
13. Indemnification
You agree to indemnify and hold harmless Send A Lead from claims arising from your use of the Services, communications, Customer Data, or legal violations.
14. Governing Law
These Terms are governed by applicable laws of the jurisdiction in which Send A Lead operates, unless otherwise stated in writing.
